Usually, yes. For business-to-business debts, the Late Payment of Commercial Debts (Interest) Act 1998 lets you claim statutory interest at 8% above the Bank of England base rate, plus fixed compensation of £40, £70 or £100 per invoice depending on its size, and reasonable recovery costs. This applies unless your contract already provides a substantial remedy for late payment. Where they apply, we add these from the first demand.
Sooner rather than later. Debts become harder to recover as they age and as a debtor’s position worsens. It is usually worth instructing us when:
Time limits apply: usually six years from when payment was due in England and Wales, and Scotland has its own time limits, which can be shorter. If the debtor can’t be found, debtor tracing can locate them and their assets.
Tell us about any dispute at the outset. We review the contract, invoices, delivery or completion records and correspondence to see whether the dispute has substance. If it doesn’t, we respond with the evidence and continue recovery. If the dispute is genuine, we advise you on the options, which may include negotiation or, with your approval, proceedings through our legal partner. Genuinely disputed debts are not usually suitable for no win, no fee, or for a statutory demand.
We assess whether legal action is worthwhile, looking at the evidence, the debtor’s finances, the likely costs and the prospects of recovery. No legal action starts without your written approval, and we tell you the costs before anything is spent. The options include:
