Court routes in Scotland

  • Simple Procedure for claims under £5,000. A streamlined route through the sheriff court.
  • Ordinary Cause for claims over £5,000. If the claim isn't defended, the court can grant decree in absence.

A successful claim ends in a decree, Scotland's equivalent of a judgment.


Enforcement after decree

Before enforcing, a sheriff officer normally serves a charge for payment, which usually gives the debtor 14 days to pay. If they don't, the main options are:

  • Earnings arrestment, with deductions taken directly from the debtor's wages
  • Bank arrestment, freezing funds in the debtor's bank account
  • Attachment, where a sheriff officer attaches certain goods

Where a company owes more than £750 and can't or won't pay, winding-up may also be an option.


Already hold an English judgment against a Scottish debtor?

It can still be enforced. You get a certificate from the English court, then register it in the Court of Session within six months. It's then enforced using Scottish diligence. We can manage this for you.


Time limits

Scotland has its own time limits for claims, known as prescription, and they can be shorter than in England. Don't leave a Scottish debt to age. We check the position at assessment.
